My current girlfriend moved to CR 10 years ago and still lives there. She married a costa rican citizen and had a child with him. she is in the process of divorcing him. She never became a citizen of CR and comes back to the states every 3 months, but the child was born in costa rica. Now she wants to move back to the states but won't leave without her child. I know the law there is that the father has to give permission for her to move the child back to the states. It does not look like he will contest the divorce but he will not give permission for her to move back to the states with the child. She has custody of the child and he only has visitation rights once a week which he hardly ever uses. He is required to pay child support but he never pays the full amount. What will it take for the court to overrule the father in this case and let the child move back to the US and how long would something like that take? The only thing she has against her is she comes back to the states every three months but she has been employed in costa rica the entire time.
